Draft Bellingen Shire 7.12 Developer Contributions Plan

Development Contributions form an important part of Council’s funding for the provision of new or augmented local infrastructure within the Bellingen Shire. The Environmental Planning & Assessment Act 1979 (EP&A Act) provides Councils with two options to levy new development to fund the provision of local infrastructure:

1. A Development Contributions Strategy based on a demonstrated nexus between additional development and the resulting additional demand for public infrastructure in accordance with section 7.11 of the EP&A Act.

2. A fixed rate levy based on the value of development works in accordance with section 7.12 of the EP&A Act.

Prior to a legislative change on 1 March 2018, the approaches to Development Contributions were known as Section 94 and Section 94A respectively.

Council currently has the following Section 94 (s7.11) Contributions Plans which are proposed to be repealed by the Draft Contributions Plan:


1. Community Facilities & Open Space Section 94 Development Contributions Plan 2014

2. Local Roads and Traffic Infrastructure Section 94 Developer Contributions Plan 2015

3. S94 Bushfire Services Contributions Plan

4. S94 Project Administration Contributions Plan


Council engaged the services of GLN Planning Consultants to undertake a review of Councils current Plans and prepare a new Draft Plan for public exhibition.

The Draft Plan, when adopted, will authorise the Consent Authority including Bellingen Shire Council (Council), a Planning Panel or a Registered Certifier to impose conditions on development consents or complying development certificates (CDCs) requiring s7.12 levies from development to which the Plan applies.

The Draft Plan has been prepared in accordance with the EP&A Act and Environmental Planning and Assessment Regulation 2000 (EP&A Regulation) and having regard to the latest practice notes issued by the Secretary of the Department of Planning, Industry and Environment (DPIE).

The Draft Plan provides a simplified way to levy development in the Bellingen Shire. The following is a summary of the proposed levy rates:

The Draft Plan is now on public exhibition and Council is seeking community feedback on the proposed Draft Plan. The exhibition period will commence on 9 April 2021 and conclude on 3 May 2021.
