Draft Planning Agreement between Bellingen Shire Council and Urunga Developments Pty Ltd ACN 616 362 433

Consultation has concluded

Council has received an offer from Urunga Developments Pty Ltd ACN 616 362 433 to enter into a Planning Agreement relating the development of 4041 Giinagay Way, Urunga. A Development Application has been approved for the subdivision of the land from 3 lots into 263 lots and associated civil works.

Council considered a report relating to this matter at its meeting of 24 March 2021, where it resolved to publicly exhibit the Draft Planning Agreement between Bellingen Shire Council and Urunga Developments Pty Ltd ACN 616 362 433.

The key effects of the Draft Planning Agreement are as follows.

  • Meet the demands created by the subdivision of the Subject Land under Development Consent 2014/DA-00129 for new water and sewer infrastructure;
  • Promote the orderly delivery of water and sewer infrastructure to the South Urunga residential precinct;
  • Establish Council’s responsibilities for the delivery of water and sewer infrastructure to the South Urunga residential precinct and the Subject Land;
  • Establish the Developer’s responsibilities for the delivery of water and sewer infrastructure to the South Urunga residential precinct and the Subject Land; and
  • Apportion to the Developer the costs for the delivery of water and sewer infrastructure to the Subject Land.

The draft planning agreement seeks to establish a contractual relationship between Council and the Developer for the delivery of water and sewer infrastructure to the Subject Land.

Council is now seeking your feedback on the Draft Planning Agreement, which is being publicly exhibited pursuant to the provisions of Section 7.5 of the Environmental Planning and Assessment Act 1979 (EP&A Act 1979).

Submissions will be received until Friday 14 May 2021. Written submissions should include the following reference;
