Public exhibition – Draft Voluntary Planning Agreement between Bellingen Shire Council and Ruby Sequoia Pty Ltd and Roses Road Trust

Exhibition has concluded - 9 November 2020

Council has received an offer from Ruby Sequoia Pty Ltd and Roses Road Trust to enter into a Planning Agreement relating the development of 2A Oak Street, Bellingen. A Development Application has been submitted for the subdivision of 2A Oak Street, Bellingen, into three (3) lots, the construction of two (2) dwellings, the construction of offices and other ancillary works

Council considered a report relating to this matter at its meeting of 23 September 2020, where it resolved to publicly exhibit the Draft Planning Agreement between Bellingen Shire Council and Ruby Sequoia Pty Ltd and Roses Road Trust.

The key effects of the Draft Planning Agreement are as follows.

  • The Draft Planning Agreement proposes to construct five (5) sealed, drained and marked carparking spaces in William Street, and a footpath connection from the carparking spaces back to Oak Street. This is in lieu of providing the three (3) spaces that would normally be required upon the development site for the office component of the development, and incorporates a multiplier of 1.5 to round up to 5.
  • The Draft Planning Agreement proposes to make a cash contribution of $42,178.26 to Council to cover the costs of works that the developer would normally be required to undertake on Halpins Lane, for the extent of the lands frontage to the lane. This money will be used by Council to undertake the requisite works on behalf of the developer.

Council is now seeking your feedback on the Draft Planning Agreement, which is being publicly exhibited pursuant to the provisions of Section 7.5 of the Environmental Planning and Assessment Act 1979 (EP&A Act 1979).

Please note that this exhibition is subject to the COVID-19 Legislation Amendment (Emergency Measures) Bill 2020 and Section 10.18 of the EP&A Act 1979 which prescribes that any requirement that a document be made available for public inspection is satisfied if the document is instead made available on the NSW planning portal or any other website approved by the Planning Secretary. The Create website has been approved by the Planning Secretary and accordingly, no hard copies of the relevant documentation will be made available for inspection.
